Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the servers and services provided by Fxolio LLC ("Fxolio," "we," "us," or "our") through BareMetalServer.ai. This AUP is incorporated by reference into our Terms of Service. By using the Service, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your account.
This AUP applies to all content stored on, transmitted through, or made accessible via servers provisioned through our platform, as well as your use of our network, platform, and management tools. You are responsible for ensuring that all users of your server, including your customers and end users, comply with this policy.
1. Permitted Uses
Our servers are designed for a broad range of lawful computing workloads. Permitted uses include, but are not limited to:
- Web hosting and applications: Hosting websites, web applications, APIs, databases, and related services.
- Blockchain and cryptocurrency: Running blockchain nodes, validators, miners, staking infrastructure, cryptocurrency wallets, decentralized applications (dApps), and related blockchain services. Cryptocurrency workloads are explicitly permitted and welcome on our platform.
- AI and machine learning: Training models, running inference workloads, data processing, and other AI/ML computation tasks.
- Software development: Development environments, CI/CD pipelines, testing infrastructure, build servers, and code repositories.
- Data storage and processing: Data analytics, backup storage, media processing, content delivery, and archival.
- Game servers: Hosting multiplayer game servers and related gaming infrastructure.
- Communication services: Email servers, VoIP, messaging platforms, and other communication tools, provided they comply with applicable anti-spam laws.
- General computing: Any other lawful use that does not violate this AUP, our Terms of Service, or applicable law.
2. Prohibited Uses
The following activities are strictly prohibited. This list is not exhaustive; we reserve the right to determine, in our sole discretion, whether any use violates the spirit of this AUP.
2.1 Illegal Activities
- Any activity that violates applicable local, state, national, or international law or regulation.
- Hosting, distributing, or facilitating the distribution of child sexual abuse material (CSAM) in any form. We have zero tolerance for this and will report violations to the appropriate authorities immediately.
- Operating or facilitating illegal gambling platforms in jurisdictions where such activity is prohibited.
- Hosting content that promotes or facilitates terrorism, violent extremism, or human trafficking.
- Facilitating the sale or distribution of illegal drugs or controlled substances.
2.2 Spam and Unsolicited Communications
- Sending unsolicited bulk email (spam), including commercial, promotional, or phishing messages.
- Operating open mail relays, open proxies, or any infrastructure primarily used for sending unsolicited messages.
- Harvesting email addresses or other contact information for the purpose of sending unsolicited communications.
- Sending messages that violate the CAN-SPAM Act, GDPR, or any other applicable anti-spam legislation.
2.3 Network Attacks and Abuse
- Launching or participating in Distributed Denial of Service (DDoS) attacks, whether originating from or directed at any target.
- Port scanning, network probing, or vulnerability scanning of systems you do not own or have explicit authorization to test.
- Packet spoofing, IP address forgery, or any form of traffic manipulation intended to disguise the origin of network traffic.
- Man-in-the-middle attacks, session hijacking, or any interception of network traffic not intended for your server.
- Operating botnets or command-and-control (C2) infrastructure for malicious purposes.
- Any activity that disrupts, degrades, or interferes with the services, networks, or servers of Fxolio, our data center partners, or any third party.
2.4 Malware and Exploits
- Hosting, distributing, or developing malware, viruses, trojans, ransomware, spyware, or any other malicious software.
- Operating phishing websites or infrastructure designed to fraudulently obtain credentials, financial information, or personal data.
- Hosting exploit kits, vulnerability databases intended for malicious use, or tools primarily designed for unauthorized access to computer systems.
2.5 Intellectual Property Infringement
- Hosting or distributing content that infringes on the copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any third party.
- Operating services primarily designed to facilitate copyright infringement, such as unauthorized streaming or file-sharing platforms.
- We respond to valid DMCA takedown notices and equivalent processes under applicable law.
2.6 Fraudulent Activity
- Using the Service for any form of fraud, including identity theft, financial fraud, or deceptive business practices.
- Creating fake accounts, impersonating others, or misrepresenting your identity or affiliation.
- Using the Service to facilitate Ponzi schemes, pyramid schemes, or other fraudulent financial arrangements.
3. Network and Resource Usage
While our servers are dedicated and you have full access to the provisioned resources, the following guidelines apply to network usage:
- Bandwidth: Servers include bandwidth allocations as specified in your plan. Excessive bandwidth usage that impacts network performance for other customers or our data center partners may be subject to throttling or additional charges.
- IP addresses: IP addresses assigned to your server remain the property of Fxolio and our data center partners. You must not engage in activities that result in our IP addresses being blacklisted. If your server's IP is blacklisted due to your activities, you are responsible for resolving the issue.
- Network configuration: You must not configure your server in a way that disrupts or interferes with the network infrastructure of our data center partners or other customers.
4. Monitoring and Enforcement
We do not proactively monitor the content of your servers. However, we reserve the right to investigate and take action when:
- We receive a credible abuse complaint or report from a third party.
- We detect activity that threatens the stability, security, or integrity of our infrastructure or network.
- We receive a valid legal request, court order, or law enforcement inquiry.
- We have reasonable grounds to believe a violation of this AUP has occurred.
Investigation may include reviewing network traffic metadata, server logs, and other relevant information. We will not access the contents of your server without your consent unless required by law or necessary to address an immediate threat to our infrastructure.
5. Reporting Violations
If you become aware of any activity on our platform that violates this AUP, please report it immediately to:

When reporting a violation, please provide as much detail as possible, including the IP address or server involved, the nature of the violation, and any supporting evidence. We will investigate all credible reports and take appropriate action.
6. Consequences of Violation
Violations of this AUP may result in one or more of the following actions, at our sole discretion:
- Warning: For minor or first-time violations, we may issue a warning and request that you remediate the issue within a specified timeframe.
- Content removal: We may remove or disable access to specific content that violates this AUP.
- Service suspension: We may temporarily suspend your server or account pending investigation or remediation. During suspension, you may not have access to your server or data.
- Service termination: For severe or repeated violations, we may permanently terminate your account and delete all associated server data without refund.
- Law enforcement referral: For activities that we believe constitute criminal conduct, we may report the violation to the appropriate law enforcement authorities and cooperate with their investigation.
In cases involving imminent harm to our infrastructure, network, or other customers, we may take immediate action (including suspension or null-routing of traffic) without prior notice. Where possible, we will provide notice and an opportunity to respond before taking enforcement action.
7. Changes to This Policy
We reserve the right to modify this AUP at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you via email or through the platform. Your continued use of the Service after such changes constitutes your acceptance of the revised AUP.
